Three members of Dunn family jailed for total of 16 years for plant machinery theft

A gang who stole £700,000 worth of heavy plant machinery which was shipped out to Eastern Europe were jailed for more than 20 years today.

Brothers Stacy and Lee Dunn, their father Lee Dunn senior and associate Richard Scales were involved in the theft of JCBs from construction sites all over Hertfordshire.

Prosecutor Simon Wilshire told St Albans crown court said the case concerned the "systematic theft" of heavy plant machinery with a view to exporting it to Eastern Europe. Police identified 17 actual thefts and two attempted thefts, but he said: "The crown consider these 19 instances to be the tip of the iceberg."

More than £700,000 of plant was taken with £309,000 recovered. One example of theft was just before ten past five on the morning of February 28 last year a JCB was stolen from a construction site in Bushey.

Mr Wilshire said the thieves failed to locate a tracking device fitted to it and police were able to establish that around 30 minutes later it was inside a barn.

The police continued to monitor the JCB in the days that followed and then on March 5 last year it became apparent the JCB was on board a Polish articulated lorry travelling on the M25 bound for Dover.

Three locations were used by the thieves to store heavy plant and machinery and change identifying features. When a stolen vehicle was recovered from the Potton End storage site, police found a cigarette butt there, which was found to contain the DNA of Lee Mark Dunn. A contact phone number given by a man when booking a storage facility at Mentmore Boat Yard could be attributed to Lee Paul Dunn. Keys to open padlocks at the site were later found by police in Lee Paul Dunn's VW car.

CCTV cameras also captured on film Stacy Dunn loading a stolen JCB onto a low loader at Fir Tree Farm.

Stacy Dunn, 36, of Cecil Street, Watford was sentenced to 5 years 9 months, his brother Lee Paul Dunn, 32, of Matlock Cresent, Watford, received 5 and a half years, their father Lee Mark Dunn of High Street, Bedmond, Abbots Langley also received 5 and a half years. They had all pleaded not guilty to conspiring to steal between January 1 2011 and March 7 last year, but were convicted by a jury.

Richard Scales, 48, of Alder Close, Park Street, St Albans pleaded guilty to conspiracy to steal and possessing 4.5 grams of cocaine which were found in 9 wraps at his home. He was jailed for a total of 4 years 4 months.

Lucy Dunn, 32, who is Lee's wife from Matlock Crescent, South Oxhey, who pleaded not guilty to two offences of transferring criminal property by paying £2,500 into her Barclays Bank account and and later withdrawing the sum of £6,000 from the account. She was found not guilty. Her husband was cleared of transferring criminal property by paying £3,700 into his wife's account For Stacy Dunn, Michael Gomulka said the thefts had been carried out late at night when nobody was about. He said there was no evidence that he had played a leading role.

Andel Singh, for Lee Dunn senior, said he was the sole carer for his wife who is on disability living allowance.

Mr Singh, who also represented Scales, asked for credit for his guilty plea and said he was only involved towards the end of the conspiracy.

For Lee Dunn junior Jonathan Mann said no violence or criminal damage had been used in the thefts.

Judge Stephen Warner said: "This was a sophisticated conspiracy to steal plant and machinery from building sites in Hertfordshire. It was over a period of 14 months and required a significant amount of planning and organisation to arrange to steal the plant, transport it to storage, to disguise it and move it out.

"The items taken were of high value. It was a lucrative trade - a commercial enterprise on a significant scale which had a serious impact on construction projects and the community."

At the end of the sentencing the judge praised the officers in the case for their investigation.

I agree with Paul Gadd. This sort of behaviour is unacceptable in a modern society. The unnecesaary disruption and additional expense caused to other law-abiding people is utterly wrong.
They have been caught, sentenced and are now imprisoned. Let them pay their debt to society - even if some think the penalties are inadequate - and then, hopefully, let us see them going straight after they are released such that they start to make a positive contribution to society instead of the negative contributions they have made so far.

There is an old saying: "If you can't do the time, don't do the crime". They knew what the risk was and now that the risk has come off they cannot complain about where they have ended up. Two wrongs do not make a right and trying to compare their crimes with the crimes of others does neither of them any good at all. For those who say "It was only theft", there is no "only" about theft. It can cause massive disruption and upset for those affected. Sometimes, as when cabling is stolen, many others are affected too - which is not right.

What do you mean "it was only theft"? Have you ever been a victim of theft? Do you know how much it can affect people? Theft is still a crime you know.

I accept it is a different league to murder, rape etc. but theft is still a crime, and they have commited numerous crimes over a prolonged period of time and have got what they deserved.

All the neast stuff being said about these thieves is justified.

I agree that the legal system is wrong, and they have their priorities wrong. You are absolutely correct in what you say.

The correct outcome would have been to lock the lot of them up. Society would be a lot better without thieves and paedo's on the streets.

They will be out in less than 2 years. They commited a crime, were caught and are paying the penalty. Thats the way justice works.

Its not only the people on here who are being judgemental. So are the court judge and the legal system. They have been proved caught, found guilty and sentenced. They should have thought of the possible consequences to their families before commiting the crimes. Their families are suffering more than they are. Very selfish actions.

What is remarkable about this series of crimes is the complexity of them. I do not understand why the people involved could not have been engaged in legal activities, which would have meant they would not be in the situation they are in now. It just goes to prove that crime is a mugs' game. They are clearly not stupid individuals; why do they not put their organising talents to better use?

It is hard to know where to start, and I'm not sure why I'm even bothering.
I do happen to be white and British, but I fail to see the significance of that at all.

How can you then go on to rant about criminals, when your 'man' is clearly one of them? A criminal is a criminal.
Who cares what colour they are, or where they come from? They are all thieves in my book, and treated the same by law.

My house is in order; we even have a go at spelling and grammar, but that is a cheap shot, I admit.

Well I think my user name says it all. I am pretty disgusted that the Watford Observer has put a facility in place that has created such a slanging match; I fail to see how any of this is helpful.

Tonight a child is in tears... why? because that child has read these comments that's why.

What was this child's crime? Being born into a family that they did not chose, but that they love with all their heart?

This is a child who knew nothing of criminal activity, who has been brought up to tell the truth, work hard and be honest - a child any mother, father or grandparent would be proud of; just as I am. A child who has never broken the law but who has had to deal with the enormity of what has happened this week. A child who is not only dealing with losing members of their family that they love from their life for a significant period of time, but also having to deal with the shock of finding out the extent of the criminal activity committed and how their life will be affected as a result.

Tonight an inocent child cries as they read how society views their family. A child who is suffering enough already.

From someone goes to work everyday, lives an honest life and who wants to ease the pain of a child.....

Please think before you type.

John Dowdle says...

It is not Watford Observer readers who should have thought about the effect of criminal activity on children but the professional criminals who fathered the children. I hope his father and the fathers of other children similarly affected will consider the impact their actions have on their own children in future. I would also hope that any other adults will also learn the lesson from this incident. Crime does not pay.

Have you considered that there is a child crying because Daddy came home to say there would be no Christmas this year because he had been laid off because someone stole his JCB and it will take 3 months to sort the insurance and buy a replacement?

Or Mummy and Daddy crying because they won't be moving house after all; someone stole all the plant and the project has been delayed, causing the whole moving house chain to collapse?

I know where my sympathy is.

All you are doing by your posts is making me realise even more how selfish and irresponsible these criminals are, and making me wish they had even harsher sentences, not least for the crimes against their own family which you describe.
What sort of low-life could do what you describe to a child?

LSC says...
1:17pm Sun 3 Mar 13

And I'll tell you why it is helpful.
Maybe, just maybe, a potential thief is reading this story.
If you are, think twice. Your actions will make your family suffer, not just you. Because you will be caught. And your children will cry.
Think about it.

You don't have to read it. And your children don't have to read it (If they CAN read it, I struggled to make any sense of it at all).

If your idea of parenting is huddling around the laptop with the kids of an evening looking at reports of why Daddy went to prison, then I'm rather frightened for the future.

It is good that you work, although I'm guessing not as a novelist or proof reader, but that is the kind of value you should pass on to your children.

Social workers often say that deprivation can be seen across and down generations. Looking at the level of literacy of some of the submissions above, one can begin to understand how this comes about. One mother has said that she is doing her best to keep her young son out of criminal ways. I hope she is successful and that her son is able to break the link between his father's criminal ways in future. She should encourage her son to work hard at school in order to get a good education so that he will be able to look forward to a future in which stealing other people's belongings is no longer necessary to survive.

The 'say it to my face' argument is always interesting. Are you suggesting that if I did they would debate me? Or punch me? Why would I want to be punched for having an opinion?

You clearly make a threat in your post. I'm middle aged and fit enough, so not afraid to answer my door, to anyone.
You will not intimidate me with threats of violence.

It isn't a question of being brave. It is a question of not sinking to your level. Threats, violence and crime.

Yes 'say it to their face' has been said a few times on here. Probably by the people closely connected with these criminals.

Don't bring yourself down to their level. You are taking your anger out on the wrong people.

We all have the right to freedom of speech and why should anyone leave their names, your point of that is... .

The fact these men are in prison, the fact their families are supposedly suffering (if I wanted to make a low dig, maybe I could ask is that because some of them are no longer benefiting from the proceeds of crimes?), the fact that we have an opportunity to comment on it is down to the 'Dunn men' and their crimes and NO ONE ELSE. If you don’t like the situation, LET THOSE MEN KNOW not us.

These men chose themselves to turn to crime, they knew the potential consequences and they are the only ones to blame for the suffering of their victims and whatever suffering their own families are going through now. Trying to justify their actions, making threats and being abusive is not going to win you the sympathy that you are so obviously looking for.

Its pathetic that in this day and age people try and blame everyone else for their actions, these men are criminals and have been caught and judged for their (known) crimes and are serving the sentence the law deamed appropriate. We don’t know their own feelings on the matter, but their family and friends should not be trying to pass the blame or the resulting consequences onto anyone else.

Trying to justify it as 'just theft' is contemptable and shows no sympathy in turn for their victims. But you're right, its not on that peodophiles can get lighter sentences. But that just means peodophiles should have longer sentences not that the 'Dunn men' have been treated too harshly.

If you don’t like this then tell your men not turn to crime in the future. That way they wont go back to prison in the future, you wont feel the need for sympathy (nor will there be any victims who deserve it far far far more) and we wont have an opportunity to be delighted that they as criminals have been caught and are doing time. Simples

I believe the law in California in the USA is such that repeat offenders are subject to the "three strikes and you are out" baseball rule.
This means that any person who is convicted three times of serious offences like the ones committed here is then jailed FOR LIFE - with no possibility of parole - EVER.
Based on this criterion, these men - and their families - can count themselves fortunate to be living in a country with such soft sentencing.

At the end of the day, they can't blame anyone but themselves, and I'm sure their poor suffering families didn't suffer when they were living off their illegal earnings. Now they know the meaning of karma.
You should seriously think before u comment that statement u put up isn't true ....... About families

So why should the family of criminals get any sympathy when they and those around dont show any for the real victims of their loved ones actions??

You should be thanking your lucky stars the courts didn't come after the missing money. You'd probably be homeless, and then you'd really have something to moan about.
Of course the insurance companies will get back the £400,000 (that we know about) by increasing premiums to honest, hard working people.

Thats before you get to the costs to all tax payers of the police, legal and court expenses and of course their upkeep in prison for the duration of their sentence and then probation officers etc after that.

Of course the family would argue all that particular cost would not have been incurred if the police hadnt gone after criminals, after all they were 'just' theiving and thats apparently okay according to them

Certainly. You are living off money from crime. £400,000 that we know about came into your family. Probably much more that we don't. Every penny of that costs the tax payer; not least in feeding your 'fella' three times a day for 3 years. I pay for that. I pay for his heating, his lighting, his water. I pay for his clothes, his bed. I also pay for his crimes. My insurance is though the roof thanks to criminal scum. You, in the mean time enjoy the £400,000 that we know about. Stolen from me and thousands of others who are honest and decent people.

Inviting people to meet you in person and tell you to your face what they are saying on a forum is usually taken as an threat of violence even if that violence isnt expressly stated.

Maybe those threats should be reported too? I believe threats of violence is a criminal matter whilst libel is a civil one so I think I know who'd be in more trouble.

I'm sure its not easy having to deal with family members going to prison, however what dont you understand about them being criminals and deserving their sentence? What do you also not understand about right minded people being happy to see criminals getting what they deserve?

I'm sure its not nice having your family members being called names, but they brought that onto themselves. They arent innocent shrinking violets, they are organised criminals who didnt think twice for the feelings or effects of their crimes on their victims OR on their own family members should they get caught.

Once again the ONLY people you should be directing your anger at are your family members. THEY did the crime and if that makes life hard for you THEY are responsible not us.

OK. From one of the family:

"they will not be away for ever!! Take care!!"

I take that to mean I should take care upon the release of these people, as they may wish to discuss the matter further. Plus numerous requests to 'say it to their faces', which again I suspect, is something that you hope would end up in violence.

True. But the article clearly states that nearly £400,000 is still missing. I didn't write the article.
Now, it is possible the men spent all that money on themselves, in a Casino or something.
But it is also possible they paid the mortgage with it, where the family still live. Or bought a car or two, still in use by the family. Or they all enjoyed some good holidays on the stolen money.
That is the reason for my lack of sympathy for the family.

I would notice an extra few hundreds of thousands of pounds appearing in my weekly housekeeping budget, but perhaps this family didn't.

What are you saying ...... Yes I been on holiday last year and i drive a convertible paid for by me ...... And the house I live in ..... Is paid for by hard work ........ We ain't living off any off that money ........
Does beg the question, if on what you alone earn you can afford a mortgage/rent, afford to buy and drive a convertible and go on a holiday why your partner was thieving in the first place?!

It also begs the question of what exactly he has done with his share of the loot.

And did you know of his criminal activities? I'm guessing you'll say no, so why are you trying so hard to stand up for someone who not only lied to you but has tens of thousands of pounds stashed away somewhere whilst you apparently work hard to support him and provide a roof over your heads, a nice car to drive and a holiday for the both of you?

This is an article about criminals who having been caught have been convicted for (their known) crimes. We are discussing what is now legal fact, their guilt has been proven. Where is the scare mongering please?

And nothing facist or weird about being happy to see criminals getting their just desserts.

What's weird is how you obviously have no clue why these men don’t deserve sympathy and how the words of their family members and friends have further alienated them/you all! What's weird is that there appears to be a sub culture in our land that believes not only that a life of crime is a commendable profession but that if caught criminals should be given sympathy for having failed in their endeavours and who are shocked that they should end up in prison! That’s just not normal.

Cheers Big Bad J, it appears you do have a sense of humour after all.

We 'need' crime, not laughed so much in quite some time! Tinged with sadness of course (see previous post). I'm assuming you're serious with that? What next, we need heart disease so that doctors have something to do? We need horsemeat in our burgers so that lab scientists can have work finding out what unknown delights are in our food? We need wars so that people can be employed making bullets? We need more Chernobyl's so that wide areas of land become unfit for human habitation which allows the local flora and fauna to grow in peace and for said flora and fauna to be allowed to mutate into new species? Its logic of sorts, just hugely flawed.

As to no one getting hurt, maybe not physically (but that might change given all the lovely threats some of you lot have bandied about) but businessess and individuals (and their associated co workers, employees, families etc) will have suffered. I run a business, if some of my equipment gets stolen yes I'll be insured for the actual equipment but not for the lost income and its not like the insurers pay out the next day is it.

Does everyone deserve sympathy? I would actually have some for the family if they hadnt come on here trying to claim as you are 'no harm done' or that the Dunn men were being harshly treated and that their actions were just some jolly jape gone wrong. The people that deserve the sympathy in this instance are those they stole from, no one else.

No, people who steal JCB's are the criminals. The policemen who recover the proceeds of crime are part of the thin blue line protecting decent people from said criminals and helping to ensure that crime does not pay.

Maybe your animosity is down to your own criminal behaviour and getting caught? In which case if criminals dont like SOCA they must be doing a great job and therefore good on them, long may that continue

I'd rather be a do gooder than a criminal, especially one behind bars. What kind of sad life is it when having your freedoms restricted, but being able to watch all the TV you like is considered a holiday?

Next time I'm on a sandy beach enjoying the balmy sun and sea I'll have to remember that comment. The next lovely spring day when I fancy buying an ice cream and sitting on a park bench enjoying the suns rays I'll have to remember that comment. Next time I go to the pub, or a football game, or the cinema,or a meal out or enjoy the company of friends and family in a social setting I'll have to remember that comment. Next time I need the loo in the middle of the night and can use one instead of peeing in a pot I'll have to remember that comment. Next time I fancy popping out to get something nice from the shops and I'm not stopped by walls/fences/locked doors/prison guards, I'll have to remember that comment. Davey, you're father christmas come early. These guys are okay because they werent working a job on minimum wage! Brilliant, sorry Big J, this is now the biggest laugh I've had in some time. Lol, have I been kidnapped by aliens and transported to a world which looks similar to earth but with opposite values? These guys are criminals, thieves. There is nothing noble in that, there is nothing noble in stealing. They arent modern day Robin Hoods taking from the rich to feed the poor. They werent on the streets with nowhere to turn but theft to survive. They didn’t steal a loaf of bread to feed their families. One of the funniest comments pages ever on here by far...

Reminds me of a humourous story I heard years ago. A spate of similar "thefts" were happening around central Scotland in the mid 80s. It transpired that some gang stole equipment from a company that was under "protection" from a few notorious characters of the Glasgow underworld. I would presume the debt would have been passed on and spent either most of their lives in hiding or are now "embalmed" within the flyover supports of the M8 motorway lol.

Whenever someone comes out with 'you wouldn’t dare tell them to their face' it always sounds like a not very well disguised threat, that if we did tell them to their face we would be subject to aggression and violence of some sort. It also gives out the impression that a) what we are saying is wrong and b) that those who we are commenting on are totally incapable of holding a proper discussion. I could add c) it gives the impression that the men don’t actually believe they are in the wrong. Oh, and d) also the impression that they are remarkedly thin skinned for such 'hard' men. If they cant face up to their crimes, to some home truths without resorting to violence then….

Lets get this straight, they are convicted criminals and we have every right to express our feelings at the fact they have been caught and are being punished. I am under no illusion that this must be a hard time for the family, but, and it’s a critical point this, if the fact they are in prison and if the fact that people are happy about criminals being behind bars (I don’t know these men, my feelings are at seeing justice being done in general terms) and if the families feeings are so important then the blame for ALL the families suffering lies with the men themselves.

I certainly would have more sympathy for the families if so many hadnt come on here trying to justify the crimes, trying to make out the men have been hard done by and that crime is okay. There is no justification, they are not being hard done by and NO crime is NOT okay. That is a universally accepted fact as is the fact that if you do commit a crime there is an associated punishment for it if/when caught. These men were well aware of that, they chose to take the chances, they lost. As the saying goes if you cant do the time don’t do the crime, by extention if you don’t want your family to suffer also don’t do the crime.

WFC007, we are not talking about them as if they do not exist. We are talking about them because they are very real and have committed very real crimes and are currently residing in a very real prison. Something that has been brought up a few times but never commented on by these mens F&F's is that for all the sympathy they were trying to gain (I think they've given up on that now) not once have they expressed any sympathy for the real victims here, the people they stole from. Indeed all the comments that have been made by F&F's are basically along the lines of these men have done nothing wrong and that no one has suffered. That is not true and quite frankly do people with that kind of attitude deserve any sympathy themselves?

Would just like to clarify that I am the only member of the DUNN family that has commented on here and I have not once stated that what has happend is cleaver or don't want any sympathy from ANYONE...you all have rights to voice your opinion, but some of these comments are personal, spiteful and unessasary!!

At the end of the day what they did was wrong, they have been caught and are now paying the price for their actions, their remaining families that have done nothing and now have to deal with their partners not being around for the next couple of years do not to read some of the insulting comments being put on here

I admit I have never been in a similar situation. What would I do? Well, if it was a spouse or sibling, I think I would be ashamed and embarrassed about them.

If it was one of my offspring I'd ask serious questions of myself as to where I went wrong in parenting, and I'd be ashamed and embarrassed about me.

If I knew they were up to criminal behavior and did nothing about it, I'm not sure I could live with myself at all.

LSC you would be different ..... My son who is 20 doesn't smoke or drink ..... Never been In trouble but we are talking about a family member ..... Who's an adult ....... And he done the crime so he will do the time ...... .... But the insults to the scales family and Dunn have been harsh ...... And comments about children ..... What have these children ever done to anyone on this page may I ask you you call yourselves respectable people .... ..... Children to me are innocent ...:-)

Scales, I can only echo LSC's comments. I would feel shame and embarrasment. If it wasn’t aware of his criminal activities I would also question where things had gone wrong and if there were any signs I should have picked up on to prevent this behaviour. And if I was aware then I would have told them to hand themselves in or shopped them in myself if they didn’t.

I don’t agree with the personal comments being made against children etc. but some of the Dunn mens supporters have come on here claiming that crime isnt that bad, that they have been harshly treated in comparison to totally unrelated crimes, threats have been made and so on. Those posters quite rightly were shot down for talking rubbish. And not once has anyone on the Dun mens side expressed sympathy for their victims, not once

You point out yourself that your family member is an adult, they knew what they were doing, they did what they did of their own free choice showing no regard for anyone else. If the posters are to believed they have also lied and hidden not just activities but profits of their criminal acts from their family. So whilst its great that their families show loyalty to them,of the comments are to be believed they showed no loyalty or thought for their families themselves. All I can say once again is all the repurcussions for their actions fall on them. If this is a hard time for the family, that is down to them not us.
