Jude Smyth of Abbots Langley banned from pubs and clubs after drunken fights

An Abbots Langley man with a kidney disease has been banned from pubs and clubs after ending up in court for drunken fights for the second time in two years.

Jude Smyth, 24, also had a curfew imposed on him when he appeared in St Albans Crown Court on Friday after admitting to assaulting Alex Raher by beating, damaging property and breaching a suspended sentence.

The latest charges come after he was given an eight-month jail sentence suspended for two years in April 2011 for a fist fight in which a man's jaw was broken.

Defence barrister Geoffrey Birch said Smyth had been on income support having suffered a kidney disease but had now been given the all clear for work.

"He got drunk, lost his cool and got involved in a fight," added Mr Birch.

Judge John Plumstead gave Smyth a nine month curfew stipulating he must stay at his home in The Fairway between 9pm and 4.30am.

In addition to the curfew he ordered Smyth not to go into licensed premises until the suspended sentence is over.

Smyth was also ordered to pay the victim, Mr Raher, who suffered a bleeding nose after being hit, £500 compensation.

He said: "You very nearly got to the end of the suspended sentence. The current offence is much less serious. Most of your problems have been drinking with a bad crowd. You are not allowed in premises where alcohol is served."

I don't understand. He offended while under a suspended sentence. Why is he not now serving that sentence?
Or is, as we all suspect, a suspended sentence as good as nothing at all and most certainly regarded as much by criminals?

He should have been in jail after the first attack and should be in jail now.

I know judges have guidelines to follow however when is the message going to get through that soft 'let off' sentences are no good and as this chap shows are no deterrent at all?

Garston Tory, I suppose the late night economy in Watford that you are a fan of, helped with his sobriety?

Nothing wrong with a late night economy, we don't (yet) live in a complete nanny state, it's the people who get out of control that are the problem and there are laws against that.

Sally, when you read someones comments try and actually comprehend what is being said. If you do you'll find that I have never said I am a fan of the night time economy
