Lawyers for a 33-year-old man accused of the murder of a young father in a Watford car park are to apply to have the case against him dismissed.
Michael McInerney, of no fixed address, was arrested in Corby in December and charged with murder following the death of Prasanna "Nick" Arulchelvam.
Three others were also arrested for assisting an offender.
Mr Arulchelvam, 34, a shopkeeper and father of one from Watford, died on June 6, 11 days after being attacked outside Costo in Hartspring Lane.
McInerney appeared before Judge Richard Foster at Luton Crown Court on Friday where his barrister Gideon Cammerman said the defence would be arguing for the case to be dismissed.
The judge remanded McInerney in custody. No date was fixed for the dismissal hearing.
In October, two men were jailed after admitting the manslaughter of Mr Arulchelvam.
