Twenty-seven-year-old Aseb Khan on a suspended prison sentence for his part in breaking a man’s jaw failed to keep to a curfew imposed instead of going into custody.

Khan was given a 34-week prison sentence suspended for two years after admitting affray outside the Moon Under the Water pub in Watford town centre.

During the fight involving two others the victim Mr Galligan had his jaw broken following an argument.

Along with the suspended sentence Khan - who is from Watford, but now lives in London Road, St Albans – was supposed to keep to a six-month home curfew between 9.30pm and 6am each day.

However he was brought before St Albans Crown Court on Tuesday for breaching the curfew on numerous occasions.

Defending, Andrew Kerry, asked recorder Peter Guest to impose a further curfew, but not as long or onerous as the previous one.

He said Khan, who is deaf, has trouble “organising himself” and if the curfew were from 10.30pm and only for three months it would assist Khan in complying with it.

Mr Kerry said Khan had a baby sitting job, which sometimes made him late and he missed the bus on other occasions.

Recorder Guest pointed out that a number of the breaches of curfew were when Khan went out after midnight and did not return until the early hours of the morning.

“There are breaches where he goes out late at night apparently in open breach of the order. That is not because the bus is late,” he said.

Khan will be tagged while on another six-month curfew under the same conditions.

Recorder Guest said: “I have no doubt it was pleasant being out until the early hours of the morning, but it is intended to be a restriction on your liberty.

“Even if I made allowances for coming home late you have been taking the Mickey.”

He added: “If you breach the curfew again on the next occasion the court may be less sympathetic than I have today. The potential is to serve a prison sentence for the original offence.”

No costs were awarded because Khan is unemployed.
