Community order for 'pest'
Twenty one packets of peanuts fell out of a drunk's sleeve when he was being thrown out of a Watford pub.
Gavin Payne, 28, had just been released from prison when made threats to the landlord of Columbia Press in The Parade, St Albans crown court heard today (Thursday).
Prosecutor David Chrimes said Payne was in breach of an anti-social behaviour order banning him from being drunk in public. He said: "It was drunk and yobbish behaviour in the pub, three days after the defendant had been released from prison. Outside the pub the packets of peanuts fell out."
Payne, of Horseshoe Lane, Watford admitted breaching an ASBO, using threatening behaviour and theft on January 7.
He had been sentenced to 18 months jail by St Albans crown court on August 29 last year for common assault and breaching an ASBO that had been imposed in Watford in June 2006. That sentence had been reduced to nine months by the court of appeal.
Defence barrister Heather Shimmen said Payne had sent a letter of apology to the court. She said he was seeking help for his alcoholism.
Judge John Plumstead passed a two year Community Order with a two year supervision programme with a condition that he attends an offender substance abuse programme.
He told him: "Your addiction to alcohol is a problem for yourself and a problem for others. When you are drinking it looks as if you become really obnoxious. You have been a pest to the public and no credit to yourself."
