A biscuit factory worker fired for turning up to work allegedly smelling of drink has lost his unfair sacking claim.
Iain Waters, 40, a warehouse operative at United Biscuits' McVities factory in Tollcross, Glasgow, was sacked in May last year.
Mr Waters, from Dennistoun, had been at his pregnant girlfriend's father's funeral the day before and had drunk six to eight small bottles of beer between 4pm and midnight.
He said he hadn't slept well, then slept in. He rushed out without freshening up or having breakfast.
Line leader Angela McCulloch accused him of smelling of drink and he wasn't allowed to work in the warehouse area.
He was subsequently sacked for gross misconduct.
The Glasgow employment tribunal ruled Mr Waters was not unfairly dismissed.
United Biscuits' policy was quite clear that incapability through alcohol would be treated as gross misconduct.
