Labour council members are seeking to overturn a controversial new policy which states that wheeled bins which are not closed will not be emptied by refuse collectors.

The policy was introduced in August by the borough council's ruling Conservatives to reduce the amount of waste going to landfill and encourage recycling.

Two weeks ago the Tories reached a further decision that anyone who persistently over-fills their bin, so that it is not emptied by refuse collectors, should be prosecuted.

Labour members argue that it was against the council's constitution to approve both of the policies without the issues first being debated by the relevant scrutiny committee.

The group wants the new bin lid rules dropped, at least until households are provided with a range of containers in which they can place different recyclable materials for collection.

Councillor Leon Reefe, Labour's spokesman on infrastructure, said: "If they are going to prosecute and penalise people like this, they need to have the necessary receptacles in place."

The Conservatives claim the rules are necessary to promote recycling.
